Bulgaria: New Notification and Document Retention Requirement for Foreign Employers Seconding Employees

Foreign employers seconding employees to Bulgaria must comply with new notification and document retention rules by February 10, 2017.

Notification Rule Details

Foreign employers seconding employees to Bulgaria must file a form with the Labor Inspectorate by February 10, 2017. The foreign employer may authorise the Bulgarian host entity to file the form on its behalf through a representative employee.

Italy: New Obligations Take Effect for Foreign Companies Posting Foreign Workers

On December 26, 2016, The Ministry of Labour and Social Policy launched a new online portal to accept mandatory notifications from EU and non-EU employers seconding employees to Italy.

Employers are also required to report any updates to their employees’ information within five days of the change, maintain employee documentation for up to two years after the assignment end date, and appoint a company representative.

Switzerland: Third quarter quotas exhausted

The third-quarter quotas for L- and B-Permits for European Union nationals on assignment lasting more than four months have been exhausted. Employers who wish to send EU nationals on assignment to Switzerland will need to wait until October 1, 2016, when fourth-quarter quotas become available.

Canada: Vancouver Mayor's proposal could affect Domestic Secondments and Global Assignments

Vancouver's mayor has announced that the city is looking at imposing a tax on vacant homes.

Depending on how the proposed law is written this could increase the cost of domestic secondments and global assignments. However, we first have to remind ourselves of Canadian Revenue Agency (CRA) guidelines for such assignments.

Belgium: Information technology sector facing increased inspections

The labour inspectorate has increased both announced and unannounced inspections of Belgian companies that employ foreign nationals in information technology positions. The focus has been on companies that may have hired Indian nationals to replace local workers.

Employers, contractors and subcontractors should expect checks for the following information, among other documentation, during an inspection:

Following the Swiss Federal Council’s release of 500 L-Permits for the first quarter of 2016, the quota for L-permits for EU nationals on assignments lasting more than four months has been exhausted. Employers who wish to send EU nationals on assignment to Switzerland will need to wait until April 1, 2016, when second-quarter quotas become available.
